Family Migration Program
There are several migration visa options available for fiance(e)s, partners, children, parents and other family members of Australian citizens, Australian permanent residents or eligible New Zealand citizens.
There are no skills or language fluency tests for Family Migration Visa applicants.
There are four main categories for family migration program:
Partner visas
Parent Visas
Child
Other Family
General Skilled Migration
The program is designed for those skilled migrants who can help to overcome skill shortages in Australia. Some classes of the visa do not require applicants to have an employer or relative sponsor them.
All GSM visa applicants must:
Be less than forty five years old;
Have good English language skills;
Have a post-secondary qualification;
Nominate a skilled occupation which is listed in the Skilled Occupation List (SOL);
Have relevant work experience in the nominated occupation.
Skilled Work Regional visa (subclass 491)
Applicants must be either sponsored by an eligible Australian relative living in a "Designated Area" or nominated by a participating state or territory government agency.
The current passmark for subclass 491 is 65 points
The visa is valid for five years. When you hold this visa you must abide by the condition that you live, work and/or study in "Regional Australia" or a "Designated Area".
In order to apply for this visa subclass, you must:
Be under 45 years of age;
Have good English language skills;
Have the skills and qualifications that meet the Australian standard for an occupation on the Skilled Occupation List (SOL);
Be either sponsored by an eligible Australian relative living in a "Designated Area" or nominated by a participating state or territory government agency.
The advantages of this visa are that:
You may live and work in Australia for five years;
It provides a pathway to Australian permanent residence;
Your family may accompany you and they may work and study, but only in specified regional area of Australia.
491 visa holders are eligible for Medicare.
Skilled Work Regional Visa (subclass 491) replaced the subclass 489 first provisional stream.
Skilled Nominated (Subclass 190)
This visa is designed for those people who have good English language skills, as well as skills and qualifications for an occupation which is in demand in Australia.
When you apply for the Skilled Nominated Visa, your application will be assessed against a points test. If you attain the pass mark, your application will be processed further.
The advantages of this visa are that:
You may travel to and enter Australia for five 5 years from the date the visa is granted;
Its expiry does not affect your permanent resident status if you are in Australia;
You may live and work in Australia on a permanent basis;
You could be eligible for Australian citizenship.
Skilled Independent (Subclass 189)
This visa is designed for those people who have good English language skills as well as skills and qualifications for an occupation for which workers are in demand in Australia.
When you apply for the Skilled Independent Visa, your application will be assessed against a points test .If you attain the pass mark, your application will be processed further.
The advantages of this visa are that:
You do not need sponsorship to apply for this visa;
It allows you to travel to and enter Australia for five 5 years from the date it is granted;
Its expiry does not affect your permanent resident status if you are in Australia;
You may live and work in Australia on a permanent basis;
You could be eligible for Australian citizenship;
Your family may accompany you, and they may work and study in Australia.
Skilled Graduate (Subclass 485)
This visa is an eighteen-month temporary visa for overseas students who have obtained an Australian qualification in Australia as a result of at least two 2 years' study.
It allows applicants who are unable to pass the points test to remain in Australia for eighteen months to gain the skills and experience needed to apply for a permanent or provisional General Skilled Migration visa.
There is no points test for applicants.
You must be in Australia to apply for this visa.
Business Migration Program
Investor Stream
This stream is designed for those people who have a successful business or investment career, and have genuine and realistic commitment to being involved in investing, or in business, in Australia.
This is a temporary visa and you should meet the following criteria prior to submitting an expression of interest:
be under 55 years of age.
score at least 65 on pointing system
have a high level of management skill in relation to eligible investments or qualifying business activity
have at least three years' experience of direct involvement in managing a business or eligible investments
have a genuine and realistic commitment to continuing your business and investment activity in Australia
You must also:
have a total assets of at least AUD 2.25 million for the two fiscal years immediately before you are invited to apply
have an overall successful record of eligible investment or qualifying business activity
be ready to make a government-approved designated investment or managing your eligible investment of AUD 1.5 million for at least one of the five fiscal years before you are invited to apply
managing a qualifying business in which you owned at least 10 per cent of the total value of the business.
Business Innovation stream
The business innovation stream is designed for those business people who want to own and manage a new or existing business in Australia and have a a genuine desire to manage their business in Australia.
This is a temporary visa and you should meet the following criteria prior to submitting an expression of interest:
be under 55 years of age.
score at least 65 on Pointing System.
have a total annual turnover of at least AUD 500 000 in at least two of the four fiscal years immediately before you are invited to apply
own at least one of the following percentages of your main businesses:
51 per cent of a business with a turnover of less than AUD 400 000 per annum
or 30 per cent of a business with a turnover of more than AUD 400 000 per annum
or 10 per cent of a publicly-listed company
have spent less than half your time on managing your business
You or your partner must also:
have total assets of at least AUD 800 000 that have been legally acquired and able to be legally transferred to Australia within two years of the visa being granted
have an overall successful business career with no involvement in unacceptable business activities.
Employer Sponsored Visas
Temporary Skill Shortage Visa (Subclass 482)
Temporary Skill Shortage Visa (TSS) is designed to enable employers to employ overseas skilled workers to fill a position. There is no age requirement for a TSS visa applicant.
The TSS visa is a temporary visa and the holder can stay in Australia with his/her family unit for the period specified in the visa grant notification.
There are three streams available in TSS visa program:
Short-term stream: this stream is for employers to employ skilled overseas workers to fill short-term positions for a maximum of two years (or four years if an international trade obligation applies) for the occupations listed on the Short-term Skilled Occupation list;
Medium-term stream: this stream is for employers to employ overseas workers to fill medium-term positions for up to four years for the occupations listed on the Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL) . There is a transitional pathway available to the employees to gain permanent residency after three years.
Labour Agreement stream : this stream for an employer upon reaching to a labour agreement with the Department of Home Affairs ( DOHA) to employ skilled overseas workers
